These Terms of Service govern your use of the Sprai app, website, and related services.
Sprai is operated by:

By accessing or using Sprai, you agree to these Terms. If you do not agree, do not use Sprai.
1. Who Can Use Sprai
You must be at least 16 years old to use Sprai, unless your parent or legal guardian has allowed your use where required by law.
If you use Sprai on behalf of a gym, business, club, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Your Account
- You are responsible for activity under your account.
- You must provide accurate account information and keep it reasonably up to date.
- You must not share login credentials or access tokens in a way that compromises the security of Sprai or other users.
- Sprai may suspend or terminate accounts that violate these Terms, create legal risk, create security risk, or harm other users or the service.
3. The Service
Sprai helps climbers upload spraywall photos, detect holds, create problems, log sends, and share climbing-related content.
Sprai is not safety equipment. Sprai does not verify the physical safety of walls, holds, routes, gyms, training plans, or climbing conditions. Climbing involves risk. You are responsible for your own judgment, safety, and use of appropriate equipment and supervision.
4. User Content
You may upload or submit content such as wall photos, videos, problem data, hold feedback, captions, profile information, comments, and send logs.
You keep ownership of content you submit, but you are responsible for it.
You represent that:
- you own the content or have the rights needed to upload and share it;
- your content does not violate any law or third-party rights;
- your content does not violate privacy, publicity, intellectual-property, or confidentiality rights;
- your content does not contain malware, harmful code, or abusive automation;
- you have any necessary permission from people shown or identifiable in uploaded photos or videos.
5. License You Grant to Sprai
By submitting content to Sprai, you grant Sprai a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, adapt, analyze, process, create derivative works from, and otherwise use your content and related metadata for the following purposes:
- operating and providing Sprai;
- storing, syncing, displaying, and sharing content according to product functionality and your settings;
- generating and displaying hold detections, segmentations, annotations, previews, and related outputs;
- debugging, securing, maintaining, and improving the service;
- developing, training, testing, validating, benchmarking, and improving models and machine-learning systems;
- handling support, safety, abuse, and quality issues;
- creating aggregated, de-identified, or statistical data and analytics.
This license continues for as long as needed to provide the service and for a reasonable period for backups, legal records, safety records, and previously created derived or de-identified materials. If derived data or model artifacts no longer identify you, they may continue to be used. Nothing in this section limits your privacy rights under applicable law.
6. Sprai IP and AI Outputs
Sprai and its software, models, workflows, designs, branding, databases, datasets, annotations, and service-generated outputs are protected by intellectual-property and other laws.
This includes hold detection results such as segmentations, polygons, masks, confidence data, derived wall maps, and similar AI-assisted or rules-based outputs generated by the service.
Subject to your compliance with these Terms, Sprai grants you a limited, non-exclusive, non-transferable, revocable license to use the app and its outputs for your personal or internal climbing-related use within the normal functionality of Sprai.
You may not:
- scrape, crawl, harvest, or bulk-extract content or service outputs from Sprai;
- copy, sell, sublicense, republish, or redistribute hold detections, segmentations, or derived wall maps outside Sprai without written permission;
- use bots or automation to collect content, hold maps, annotations, or outputs at scale;
- use Sprai outputs to build, train, validate, benchmark, or improve a competing dataset, model, product, or service;
- reverse engineer, decompile, or attempt to derive source code, models, prompts, or internal logic, except where applicable law does not allow this restriction;
- bypass access controls, rate limits, or security measures;
- remove legal notices or branding.
7. Acceptable Use
You agree not to:
- violate laws or regulations;
- infringe intellectual-property, privacy, publicity, or other rights;
- upload unlawful, deceptive, harassing, hateful, violent, sexually explicit, or otherwise abusive content;
- impersonate another person or misrepresent your affiliation;
- upload content that exposes private information about another person without permission;
- interfere with, disable, damage, or overload the service;
- probe, scan, or test the vulnerability of the service without permission;
- use Sprai for spam, phishing, malware, or other harmful activity;
- access or attempt to access another user's account, wall, or private content without permission.
8. Content Moderation and Reporting
Sprai may remove, restrict, or disable access to content, walls, or accounts if we believe they violate these Terms, violate law, create risk, or harm the service or other users.
Moderation may involve automated tools, manual review, user reports, or a combination of these.
To report unlawful content, rights violations, abuse, or other issues, contact support@getsprai.com with enough information to identify the content and explain the issue.
If your content or account is restricted and you believe this was a mistake, you can contact support@getsprai.com.
9. Feedback
If you send ideas, suggestions, bug reports, or feedback, Sprai may use them without restriction or compensation to you.
10. Paid Features
Sprai may offer paid features, subscriptions, or in-app purchases.
If purchases are made through Apple App Store, Google Play, or another app store, that store's payment terms, refund rules, and subscription rules may also apply.
Unless stated otherwise, fees are non-refundable except where required by law or by the applicable app store rules.
11. Availability and Changes
Sprai is an evolving product operated by an independent developer. Features may change, be limited, suspended, or removed at any time.
Sprai does not guarantee that the service will always be available, uninterrupted, secure, or error-free.
12. Termination
You may stop using Sprai at any time.
Sprai may suspend or terminate your access if necessary to protect the service, comply with law, investigate abuse, enforce these Terms, or prevent harm to users or Sprai.
Sections that by their nature should survive termination will survive, including sections about user content licenses, Sprai IP, restrictions, disclaimers, liability, governing law, and dispute terms.
13. Disclaimers
Sprai is provided “as is” and “as available”.
Hold detection and other outputs are generated automatically and may be incomplete, inaccurate, or unsuitable for your use. You are responsible for reviewing outputs before relying on them.
Sprai does not provide professional climbing, medical, safety, training, or route-setting advice.
Nothing in these Terms limits statutory rights that cannot be limited by law.
14. Liability
Sprai is liable without limitation for intent, gross negligence, injury to life, body, or health, fraudulently concealed defects, guarantees expressly assumed, and liability under mandatory law.
In cases of slight negligence, Sprai is liable only for breach of material contractual obligations. Material contractual obligations are obligations whose fulfillment is necessary for proper performance of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to foreseeable damages typical for this type of contract.
Otherwise, liability for slight negligence is excluded to the extent permitted by law.
The same limitations apply to Sprai's legal representatives, employees, contractors, and agents.
15. Governing Law
These Terms are governed by the laws of Germany, excluding conflict-of-law rules.
If you are a consumer living outside Germany, mandatory consumer protection laws of your country of residence may still apply.
16. Consumer Dispute Resolution
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17. Changes to These Terms
Sprai may update these Terms from time to time. The updated version will be posted on the website or in the app with a new “Last updated” date.
If changes are material, Sprai may provide additional notice where appropriate. Continued use of Sprai after updated Terms take effect means you accept the updated Terms.
